Terms of Service

1. Acceptance of Terms

By accessing or using the IdentifyMyPest website (identifymypest.ai) and its services, you agree to be bound by these Terms of Service. If you do not agree to these terms, you must not use our services. We reserve the right to update these terms at any time, and your continued use of the service constitutes acceptance of any modifications.

2. Service Description

IdentifyMyPest provides two primary services:

  • •AI Pest Identification: Users can upload or capture photos of pests, which are analyzed using Google Gemini AI technology to provide a probable identification, general information about the pest, and suggested treatment approaches.
  • •Exterminator Directory and Lead Generation: Based on the user's location and pest type, we connect users with licensed pest control companies in their area. When a user submits their contact information, it is shared with relevant exterminator companies who may contact the user to offer their services.

3. AI Identification Disclaimer

The AI-powered pest identification provided by IdentifyMyPest is intended for informational purposes only and is not a substitute for professional pest inspection. Important disclaimers:

  • •Identification results are probabilistic and are not guaranteed to be accurate. The AI may misidentify species or fail to identify certain pests.
  • •Treatment recommendations provided are general in nature and should not replace professional assessment by a licensed exterminator.
  • •Photo quality, lighting, angle, and other factors can significantly affect identification accuracy.
  • •IdentifyMyPest does not guarantee that any specific pest identification result is correct and shall not be held liable for actions taken based on AI identification results.
  • •For health-threatening pest situations (e.g., venomous spiders, disease-carrying insects), always consult a professional immediately rather than relying solely on AI identification.

4. User Obligations

By using our services, you agree to:

  • •Provide accurate and truthful information, including your name, contact details, and address.
  • •Only upload images that you have the right to share and that are relevant to pest identification.
  • •Not use the service for any unlawful purpose or in any way that could damage, disable, or impair the service.
  • •Not attempt to reverse engineer, decompile, or extract source code from our website or AI systems.
  • •Not submit harmful, offensive, or inappropriate content through our upload or communication features.
  • •Be at least 18 years of age to use our services.

5. Exterminator Listing Terms

Pest control companies listed on IdentifyMyPest are independent businesses and are not employees, agents, or representatives of IdentifyMyPest. Important clarifications:

  • •IdentifyMyPest does not guarantee the quality, safety, legality, or timeliness of services provided by any listed exterminator.
  • •We make reasonable efforts to verify that listed companies are licensed, but we do not warrant or guarantee their credentials, insurance, or compliance with local regulations.
  • •Any contract for pest control services is exclusively between the user and the exterminator. IdentifyMyPest is not a party to such agreements.
  • •Disputes between users and exterminators must be resolved directly between those parties. IdentifyMyPest is not responsible for mediating or resolving such disputes.
  • •Exterminator companies may pay fees to IdentifyMyPest for lead generation and listing services. This commercial relationship does not affect the independence of our pest identification results.

6. Lead Generation Disclosure

IdentifyMyPest operates as a lead generation platform. By submitting your contact information through our service, you acknowledge and agree that:

  • •Your contact information (name, email, phone number, address) and pest details will be shared with one or more pest control companies in your area.
  • •These companies may contact you by phone, email, or text message to offer their extermination services.
  • •You may receive communications from multiple exterminator companies based on a single submission.
  • •IdentifyMyPest may receive compensation from exterminator companies for leads generated through our platform.

7. Intellectual Property

All content on the IdentifyMyPest website, including but not limited to text, graphics, logos, icons, images, software, and design elements, is the property of IdentifyMyPest or its content suppliers and is protected by Canadian and international copyright laws. Users retain ownership of photos they upload, but grant IdentifyMyPest a non-exclusive, royalty-free license to use uploaded images for the purposes of pest identification, service improvement, and AI training. This license terminates when the user's data is deleted upon request or after the applicable retention period.

8. Limitation of Liability

To the maximum extent permitted by applicable law:

  • •IdentifyMyPest provides its services on an "as is" and "as available" basis without warranties of any kind, express or implied.
  • •We shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of our services.
  • •We are not liable for any damage to property or harm caused by pests, whether or not those pests were identified by our AI system.
  • •We are not liable for any actions taken or not taken by exterminators connected through our platform.
  • •Our total liability for any claim arising from the use of our services shall not exceed the amount paid by the user to IdentifyMyPest in the twelve (12) months preceding the claim, or $100 CAD, whichever is greater.

9. Indemnification

You agree to indemnify, defend, and hold harmless IdentifyMyPest, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your access to or use of our services, your violation of these Terms of Service, or your violation of any third-party rights.

10. Service Availability

We strive to maintain continuous availability of our services but do not guarantee uninterrupted access. We reserve the right to modify, suspend, or discontinue any part of our services at any time without prior notice. We shall not be liable for any modification, suspension, or discontinuation of the service. Scheduled maintenance windows will be communicated in advance when possible.

11. Governing Law and Jurisdiction

These Terms of Service shall be governed by and construed in accordance with the laws of the Province of Quebec and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any dispute arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of the Province of Quebec, judicial district of Montreal. The parties agree that the United Nations Convention on Contracts for the International Sale of Goods does not apply to these Terms.

12. Severability

If any provision of these Terms of Service is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.
